Every chemist knows that matter does not disappear. It transforms, migrates, and concentrates. Increasingly, it also finds its way into a courtroom.

A new wave of toxic tort litigation is building around electronic waste, driven by growing volumes of discarded electronics, mounting evidence of contamination from informal recycling, expanding producer responsibility laws, and increasingly precise analytical tools. As governments broaden producer responsibility requirements and communities seek accountability for environmental contamination, plaintiffs are increasingly turning to the courts. Chemistry is increasingly central to questions of exposure, causation, and liability, critical matters in any lawsuit.

The global e-waste crisis generates roughly 60 million metric tons of discarded electronics each year and continues to grow as devices are replaced more frequently. Buried within this waste stream are some of chemistry’s most familiar toxicants: lead in solder and cathode ray tube glass, cadmium in rechargeable batteries and semiconductor components, and hexavalent chromium in anticorrosive coatings.

These hazards are not new. Their toxicology has been studied for decades, and their effects on human health are well established. What is changing is the legal landscape. Communities affected by contamination are bringing more sophisticated claims, regulators are paying closer attention to environmental releases, and advances in analytical chemistry are making it easier to connect contaminants to specific sources. Questions once confined to environmental science are increasingly becoming matters for the courts.

The exposure pathway problem

Toxic tort cases ultimately hinge on causation, and causation requires a credible exposure pathway. This is where chemists become indispensable.

In informal e-waste recycling operations across parts of West Africa, South and Southeast Asia, Latin America, and increasingly within underserved communities in higher-income countries, electronics are often dismantled through open burning, acid leaching, and uncontrolled mechanical shredding. Each process leaves a distinct chemical signature.

Burning polyvinyl chloride–coated wire releases lead-containing particulates alongside dioxins and furans. Acid recovery of circuit boards can mobilize cadmium and hexavalent chromium into wastewater that is frequently discharged without treatment. These contaminants migrate through soil, groundwater, and air, extending exposure well beyond the recycling site.

Workers in these operations often experience the greatest exposures. In countries with official, government-regulated systems for processing e-waste, workers’ compensation rights provide a first line of recourse for occupational chemical injury. But the majority of the world’s e-waste ends up in countries without such systems, where workers often lack these protections entirely.

For those workers, tort litigation remains one of the few available paths to compensation for long-term chemical injuries. These claims are typically filed against the manufacturers, exporters, or recycling companies responsible for the exposure, often in the courts of the country where the injury occurred, though sometimes in the corporation’s home country.

For plaintiffs, proving causation requires showing where contaminants originated, how they moved through the environment, and how people were exposed. Increasingly, that evidence depends on analytical chemistry, including metal speciation, isotopic fingerprinting, environmental sampling, and biomonitoring.

Why these metals matter legally

Lead, cadmium, and hexavalent chromium are both toxic and extensively regulated. Exposure thresholds established under laws such as the EU’s Restriction of Hazardous Substances Directive, the US Toxic Substances Control Act, and California’s Proposition 65 provide benchmarks that frequently become reference points in litigation.

Although regulatory thresholds do not determine negligence on their own, documented exceedances can strengthen claims involving inadequate warnings, poor waste management, or failures to control hazardous releases. As extended producer responsibility policies expand worldwide, manufacturers, recyclers, and others across the electronics supply chain may face increasing scrutiny over how products are designed, managed, and ultimately disposed of.

Cadmium also illustrates why scientific nuance matters in the courtroom. Although its toxicity is well understood, questions remain about low-level chronic exposure. Courts need experts who can communicate both the strength of the evidence and the uncertainties that remain, rather than overstating either.

The role chemists must play

The chemistry community has already produced much of the science that underpins these cases through decades of work in toxicology, environmental chemistry, analytical methods, and contaminant transport. The next challenge is ensuring that science is applied accurately and objectively as litigation expands.

Chemists are uniquely positioned to answer the scientific questions at the heart of these cases. They can identify contaminant sources, reconstruct exposure pathways, distinguish anthropogenic contamination from natural background levels, and provide independent expert testimony that helps courts understand both the evidence and its limitations. Their expertise can also inform exposure standards, remediation strategies, and future product stewardship policies.

This role extends beyond supporting one side of a lawsuit. It is about ensuring that legal decisions are grounded in sound science. Chemists should participate as independent scientific experts, clearly communicating what the evidence demonstrates, where uncertainty remains, and what conclusions cannot yet be drawn.

As e-waste litigation grows, the implications will extend far beyond individual cases. Court decisions will influence how electronics are designed, how recycling systems operate, and how manufacturers manage products throughout their life cycles. They may also shape future environmental regulations and industry practices, making scientific evidence more influential than ever.
